Last week, the EU business world once again held its breath when the US President was quoted with a “recommendation” to impose 50% import tariffs on EU products starting June 1, 2025.<\/p>\n\n
One should perhaps no longer get agitated about such “announcements,” especially since a recommendation (to whom, actually?) can hardly be considered one, because the following day, in a phone call with the President of the EU Commission, it was agreed to continue negotiations until July 9, 2025. It remains to be seen. <\/p>\n\n
You should not delay in addressing this topic in more detail. It is certain that there will be changes in the import customs clearance of EU goods into the USA. Our recommendation here is to focus primarily on the concept of origin in the USA, which differs from EU law. While the USA also adheres to the principle of “substantial transformation,” it then creates numerous specific regulations. For example, the origin of a bicycle is determined by the origin of its frame. There is no processing list comparable to Annex 22-01 DelVO for determining non-preferential origin. This is naturally different in the context of preferential agreements, such as the USMCA. <\/p>\n\n
However, the rules for customs valuation are similar. The USA also refers to the WTO Rules of Origin here. However, the USA still recognizes, for example, the First-Sale Rule, meaning valuation based on the first sale for export to the USA, which can lead to different valuations in chain transactions. Similarly, there are differences in the addition of license fees. <\/p>\n\n
All of this should be examined and analyzed on a case-by-case basis. We are currently observing more intensive controls by US authorities. This situation is sure to intensify. Should anything have “gone wrong” in the past, it is advisable to consider potential self-declarations. Similar to German law, reductions may be granted if one effectively makes a voluntary subsequent declaration.
